Vibe Check - AI Relationship Message Analyzer ("the App," "we," "us," or "our"), published by EmpathySphere.

1. Acceptance of Terms

By downloading, installing, or using Vibe Check ("the App"), you agree to these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

Vibe Check is a free, ad-supported mobile application that uses artificial intelligence to analyze text messages and chat screenshots. The App categorizes messages as healthy, toxic, or neutral and provides explanations and suggested replies.

For screenshot analysis, the App uses Google ML Kit for on-device text recognition (OCR) to extract text from images before sending it for AI analysis.

Important: Vibe Check is not a substitute for professional relationship counseling, therapy, or mental health services. All AI-generated analyses are for informational and entertainment purposes only.

3. Age Requirement

You must be at least 18 years old to use Vibe Check. By using the App, you confirm that you are 18 years of age or older. We do not knowingly provide services to anyone under 18.

4. User Accounts

You may use the App as a guest or sign in with Google. If you create an account:

• You are responsible for maintaining the security of your account
• You agree to provide accurate information
• You may delete your account at any time through Settings or by contacting us

5. AI-Generated Content

The App uses AI models (including OpenAI's GPT-4o and GPT-3.5-Turbo) to analyze messages. You acknowledge that:

• AI analyses may not always be accurate or appropriate
• AI-generated suggestions should not be treated as professional advice
• You are responsible for how you use or act upon any AI-generated content
• You can report inaccurate or inappropriate AI responses using the in-app report button
• AI results are labeled as "AI-generated analysis" and carry a disclaimer that they are not professional advice

6. Virtual Currency (Gems)

The App uses a virtual currency called "Gems" that can be earned through app usage, watching ads, referrals, and completing challenges. Gems:

• Have no real-world monetary value
• Cannot be exchanged for real currency
• Can be used to unlock in-app features (streak shields, themes, avatar frames, etc.)
• Are managed through a server-authoritative system to ensure fairness
• May be modified or reset at our discretion

Anti-tampering: Gem balances are validated server-side and protected by integrity checks. Attempting to manipulate gem balances through unauthorized means (including modifying local storage, using rooted devices to alter app data, or exploiting the API) constitutes a violation of these Terms and may result in account suspension.

7. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Submit content that is harmful, abusive, or violates others' rights
• Attempt to reverse engineer, hack, decompile, or exploit the App
• Manipulate the gem economy through unauthorized means
• Use automated tools, bots, or scripts to interact with the App
• Attempt to bypass rate limits, App Check verification, or other security measures
• Inject malicious prompts or attempt to manipulate AI behavior
• Share or distribute content from the App that violates any laws

8. Advertising

The App is free and supported by advertisements. By using the App, you consent to receiving ads including banner, interstitial, and rewarded video advertisements served by Google AdMob.

• Ad personalization is subject to your GDPR consent preferences
• For EU/EEA/UK users, consent is requested before any ads are loaded
• You can opt for non-personalized ads at any time through your device settings
• Rewarded ads (for earning gems) are always user-initiated

9. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your data. Key points:

• Messages are analyzed in real-time by AI and not stored on our servers
• Screenshot OCR is performed on-device using Google ML Kit
• We do not sell your personal data
• Anonymous analytics are used to improve the app

10. Intellectual Property

All content, features, and functionality of the App (including design, code, graphics, and branding) are owned by EmpathySphere and are protected by copyright, trademark, and other intellectual property laws. The Vibe Check name, logo, and associated branding are trademarks of EmpathySphere.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:

• The accuracy, completeness, or reliability of AI analyses
• Uninterrupted or error-free operation of the App
• That the App will meet your specific requirements
• The availability of any particular feature or service

12. Limitation of Liability

To the fullest extent permitted by law, EmpathySphere shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages arising from reliance on AI-generated analyses or suggestions.

13. Account Deletion

You may delete your account at any time through the App's Settings or by visiting our Account Deletion page. Upon deletion, your personal data will be permanently removed from our servers in accordance with our Privacy Policy.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify users of significant changes through in-app notifications.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation or, if necessary, through appropriate legal channels.
